Death penalty is, indeed, still active in Colorado. However, capital punishment there is VERY rarely given--there's a total of four cases since 1976 where the jury voted to execute, and even then, three of the sentences have yet to be carried out. Still, judging by the prior cases, this really does seem like a slam-dunk if the prosecutor asks for the death penalty, barring a finding of mental incompetence.

I can't speak more on this subject, as it's even more Coz-worthy than the free will debate.
